These terms apply when you use propfact.com.au, create a PropFact account, take the free course, subscribe to the data tools or engage us under a plan. By doing any of those things you agree to them. Please read them together with our Scope of service and Privacy policy.
PropFact (“we”, “us”) provides property education, property market data tools and buyer services in Australia through propfact.com.au. Buyer’s agent work in Plan 3 is carried out by our licensed partner agency, as described in the Scope of service.
The website, the course and the data tools provide general information. They do not take account of your objectives, financial situation or needs, and they are not financial, credit, legal or tax advice. Nothing we publish is a property valuation. Figures about past prices, rents or growth are not a reliable guide to the future, and we do not promise any return. You are responsible for your own decisions, and you should get advice from a licensed professional before you act.
The course videos and workbooks are free with an account. You may watch them and fill in the workbooks for your own personal use. You may not copy, republish, sell or share them, or the links that open them, in a way that gives other people access without their own account.
The tools summarise public and licensed data about suburbs and markets. Every figure shows its sample size, but the data can still contain gaps, delays and errors, and a suburb figure says nothing certain about a particular property. Check anything important before relying on it.
Your subscription is for your own research. You must not:
What each plan includes, its fee and how it is paid are set out in the Scope of service. Before we start a Plan 2 or Plan 3 engagement, you will sign a written engagement agreement. If that agreement differs from these terms, the agreement applies.
In every plan, you make the final decision to buy, and you engage your own conveyancer, broker and inspectors.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights. If a service fails to meet a consumer guarantee, you may be entitled to have it supplied again or to a refund.
To the extent the law allows, and subject to section 8:
We are not responsible for the services of brokers, conveyancers, inspectors, property managers or other people you engage, even if we introduced them.
The website, course, workbooks, tools, scores and their design belong to PropFact or our licensors. Apart from the personal use these terms allow, you need our written permission to use them. Photos on the site are used under their licences.
You can close your account at any time by emailing us. We may suspend or close an account that breaches these terms, for example by sharing access or extracting data, after telling you why where it is reasonable to do so. If we close a paid subscription without a breach on your part, we will refund the unused part of the month.
We may update these terms. The date at the top shows when they last changed. If a change materially affects a paid subscription or an engagement already under way, we will email you before it takes effect.
These terms are governed by the laws of Western Australia. You and we submit to the courts of Western Australia and the courts that can hear appeals from them.
